ABR Brokerage ("ABR," "we," "us," or "our") operates the website located at abrbrokerage.com (the "Site"). ABR Brokerage is a boutique business brokerage powered by Commercial Acquisitions Inc., a New York State corporation with its principal place of business in Brooklyn, New York.
We provide business brokerage and intermediary services, including the marketing and sale of privately held businesses, buyer representation, business valuation, and related advisory services (collectively, the "Services").
This Privacy Policy explains what information we collect, how we use and share it, and the choices available to you. It applies to information collected through the Site, through our email and telephone communications, and in the course of providing our Services.

Depending on the interaction, this may include:

Buyer qualification information: investment criteria, industries and geographies of interest, target transaction size, acquisition timeline, background and experience, source of funds, proof of funds documentation, net worth or liquidity statements, and financing preapprovals.

Seller and business information: business financial statements, tax returns, profit and loss statements, balance sheets, lease and vendor agreements, customer and supplier information, payroll and employee census data, asset lists, and other materials relevant to valuing or marketing a business.

If you provide us with information about another person — for example, a business partner, spouse, co-investor, or employee — you represent that you have the authority to do so.

6. Confidentiality of Business Listings and Transaction Information
Confidentiality is a core obligation of our business.
Seller information. We do not publicly disclose the identity of a business we have been engaged to sell without the seller's authorization. Listings are marketed on a blind or anonymized basis. Detailed financial and operational information about a listed business is disclosed only to prospective buyers who have executed a confidentiality or non-disclosure agreement and, in our judgment, have demonstrated adequate qualification and interest.
Buyer information. Information you provide as a prospective buyer — including financial capacity, acquisition criteria, and identity — may be shared with the seller of a business you have expressed interest in, and with that seller's professional advisors, for the purpose of evaluating your inquiry. Sellers and their advisors are generally subject to their own confidentiality obligations, but we do not control their conduct.
Limits. Confidentiality obligations do not prevent disclosure where required by law, court order, subpoena, or regulatory authority, or where necessary to establish or defend a legal claim.
7. How We Share Information
We share personal information in the following circumstances:

With counterparties to a transaction. As described in Section 6, and subject to applicable confidentiality agreements.

With professional advisors. Attorneys, accountants, escrow agents, title companies, lenders, insurance brokers, and other advisors involved in a transaction.

With co-brokers and affiliates. Including Commercial Acquisitions Inc. and cooperating brokers where a transaction involves shared representation.

In connection with a corporate transaction. If we are involved in a merger, acquisition, financing, reorganization, or sale of assets, information may be transferred as part of that transaction.

For legal reasons. To comply with applicable law, respond to lawful requests from public authorities, enforce our agreements, or protect the rights, property, or safety of ABR Brokerage, our clients, or others.
We do not sell your personal information, and we do not disclose it to third parties for their own marketing or advertising purposes.
8. Cookies and Tracking Technologies
Cookies are small text files stored on your device. Our hosting platform places essential cookies on your device automatically when you visit the Site. If you provide your mobile number and consent to text messages, we may contact you by SMS regarding inquiries, listings, and transactions. Message and data rates may apply. Reply STOP to opt out or HELP for assistance. Mobile opt-in data and consent are not shared with third parties for their own marketing purposes.
10. Data Retention
We retain personal information for as long as needed to fulfill the purposes described in this Policy, including for the duration of an engagement and afterward as required to meet legal, tax, regulatory, licensing, insurance, and recordkeeping obligations, and to resolve disputes.

We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, and destruction, consistent with the New York Stop Hacks and Improve Electronic Data Security (SHIELD) Act.

In the event of a breach of private information as defined under New York law, we will provide notice to affected individuals and to the appropriate authorities as required.
12 Site Visitors

You may also opt out of marketing communications at any time. We may decline a request where we are required or permitted by law to retain the information — for example, records related to a completed transaction.
